General Terms and Conditions

1. Scope

These general terms and conditions shall apply for all contracts of Emmi Ultrasonic GmbH with consumers concluded via our online shop. A consumer is a natural person who enters into a legal transaction for a purpose that cannot be ascribed to a commercial or independent business activity.

2. Contracting Partners, Customer Service

4. Conclusion of a Contract

The presentation of products in our online shop is not a legally binding offer but a non-binding online catalogue. By clicking on the button “send order”, you are placing a binding order of the articles that were placed in the shopping cart. The confirmation of the receipt of your order as well as the acceptance of the order is sent by automated e-mail immediately after submission. With this confirmation by e-mail the purchase contract becomes legally effective. Prices: All prices are stated in Euro including the statutory value added tax. The prices are valid as of order date. It is not possible to combine more than one voucher of single campaigns at a time.

5. Shipping Costs

Delivery charges within the territory of Germany generally amount to 6.90 EUR. As far as other freight, packing and insurance fees will be charged; these are stated in the respective offers. If your consignment consists of several packages, delivery may be on different days and delivery fees shall be charged separately. Please note the delivery charges prior to confirming your order. Delivery charges, however, shall not apply for distributors or resellers. If you cannot find your desired country, please do not hesitate to contact us on info@emmi-club.de

6. Types of Payment

We accept the following payment methods: Prepayment, Paypal, credit card and via immediate bank transfer (via PayOne). Prepayment: With selection of the prepayment, we will include our bank details in the confirmation of order and deliver the goods on receipt of payment. Credit card: Your credit card will be charged with completion of your order.  

7. Collection by the Customer

We deliver by dispatch and it is also possible to directly collect the goods at our premises: Emmi Ultrasonic GmbH, Gerauer Straße 34, 64546 Mörfelden-Walldorf.

8. Setoff

The right to set off a claim is only given when your counterclaim has been legally proven or is uncontested or has been acknowledged by us in written form.

9. Right of Retention

You can only exercise a right of retention insofar as the requirements results from the same contractual relationship.

10. Retention of Title

The goods shall remain our property until full payment. If you change address in this period, please inform us of your new address immediately.

11. Cancellation Policy

Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right to cancel, you must inform us (Emmi Ultrasonic GmbH, Gerauer Straße 34, 64546 Mörfelden-Walldorf, info@emmi-ultrasonic.de, Deutschland, Phone: +496105 406794) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model cancellation form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right to cancel does not exist for the following contracts:
  • Contracts for the supply of goods that are made to the consumer’s specifications, i.e. non- prefabricated goods made on the basis of an individual choice of or decision by the consumer or are clearly personalized.
  • Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
  • Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.

The guarantee is granted in accordance with statutory regulations. With respect to all faults occurring during the statutory warranty period of two years from the time of delivery you have a statutory right to supplementary performance (your discretion: correction of the faults or delivery of new products) and - insofar the statutory preconditions apply - the statutory rights to a price reduction or withdrawal from the contract, as well as damages. You must grant us a total of two attempts at rectification of the fault. If your preferred type of supplementary performance is only possible at disproportionate costs, your claim will be restrict to the other kind of supplementary performance.

12. Cost Coverage Agreement

If you exercise your right of withdrawal, you are responsible for covering the regular cost of return postage if the goods delivered are as ordered and if the price of the goods to be returned does not exceed the amount of 40 Euro or in case of a higher price you have not provided consideration or a partial payment agreed under the terms of the contract. Otherwise, the return shipment is exempt from charges.

For security reasons the details of your order will not be accessible on the internet once you have submitted your order.

14. Applicable Law

The language available for the conclusion of the contract is German. The contract is governed by the law of the Federal Republic of Germany.
